WOGI App - General Terms and Conditions

Welcome to WOGI, a mobile application operated in Hungary and the European Union by World Gastronomy Network Kft. (registered office: 4700 Mátészalka, Bajcsy-Zsilinszky utca 17. 3/10, Hungary, company registration number: 15-09-093638, tax number: 32822359-2-12), and in the United States by American National Dishes LLC (registered office: 16192 Coastal Highway, Lewes DE 19958, registration number: 10192099) (collectively, “we,” “us,” or “our”). These General Terms and Conditions (“T&Cs”) govern your use of the WOGI app, website, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these T&Cs. If you do not agree, please do not use the Services.

 

1. Definitions

  • App: The WOGI mobile application available on iOS, Android, and other platforms.

  • User: Any individual or entity using the Services.

  • WOGI Token: A digital reward point issued and managed by World Gastronomy Network Kft. and/or American National Dishes LLC within the WOGI app, used exclusively in the WOGI loyalty program.

  • Content: Recipes, videos, comments, or other materials uploaded or shared by users.

 

2. Eligibility

To use the Services, you must:

  • Be at least 18 years old or have parental consent if under 18.

  • Provide accurate and complete information during registration.

  • Not be located in a jurisdiction where use of the Services or WOGI tokens is prohibited.

 

3. Account Registration

  • You must create an account to access certain features, such as uploading recipes or earning WOGI tokens.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

  • Notify us immediately at info@wogi.pro if you suspect unauthorized access.

 

4. Use of Services

You agree to:

  • Use the Services for lawful purposes only.

  • Upload or share Content that is original, non-infringing, and complies with our Community Guidelines.

  • Not engage in activities that disrupt the Services, including hacking, spamming, or distributing malware.

 

5. WOGI Token Program

  • Earning Tokens: Users may earn WOGI tokens through activities such as registration, referrals, recipe uploads, or social interactions, as outlined in the WOGI Loyalty Program Guidelines (available at www.wogi.pro/loyalty).

  • Loyalty Program Restrictions:

    • WOGI tokens are digital reward points with no monetary value, cannot be redeemed for cash, are non-transferable, and can only be used within the WOGI app.

    • Tokens are stored and managed within the WOGI app and may expire 12 months from issuance unless otherwise specified.

    • World Gastronomy Network Kft. and American National Dishes LLC reserve the right to adjust token balances or program rules with prior notice.

  • Use of Tokens: Tokens can be redeemed for in-app benefits, such as discounts, exclusive content, or participation in special events, as detailed in the Loyalty Program Guidelines.

  • Tax Responsibility: As WOGI tokens have no monetary value, their use does not typically generate taxable income. Users are responsible for consulting local tax authorities if applicable (in Hungary, the National Tax and Customs Administration [NAV]; in the USA, the Internal Revenue Service [IRS]).

 

6. Intellectual Property

  • Our IP: The app, its design, logos, and proprietary content are owned by World Gastronomy Network Kft. and/or American National Dishes LLC and protected by intellectual property laws.

  • User Content: By uploading Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it within the Services to promote the WOGI ecosystem.

  • Feedback: Any suggestions or feedback you provide may be used by us without compensation.

 

7. Privacy

Your use of the Services is governed by our Privacy Policy, available at www.wogi.pro/privacy, which details how we collect, use, and protect your data in compliance with GDPR, Hungarian data protection laws (Act CXII of 2011), and U.S. data protection regulations (e.g., CCPA where applicable).

 

8. Prohibited Conduct

You may not:

  • Upload Content that is defamatory, obscene, or violates third-party rights.

  • Use automated tools to scrape or extract data from the Services.

  • Attempt to reverse-engineer or interfere with the app’s functionality.

  • Misrepresent your identity or affiliations.

 

9. Termination

  • We may suspend or terminate your account for violating these T&Cs, with or without notice.

  • Upon termination, you will lose access to earned WOGI tokens, as they are non-transferable and tied to the app.

  • You may delete your account at any time, forfeiting any unused tokens.

 

10. Disclaimers

  • The Services are provided “as is” without warranties of any kind, express or implied.

  • We do not guarantee the accuracy of user-generated Content or the availability of WOGI token rewards.

  • The availability of certain in-app benefits may be subject to change based on program updates.

 

11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages arising from your use of the Services.

  • Our total liability shall not exceed $100 or the value of in-app benefits redeemed by you, whichever is lower.

 

12. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Services, violation of these T&Cs, or infringement of third-party rights.

 

13. Governing Law and Dispute Resolution

  • These T&Cs are governed by the laws of Hungary for users in the EU, while U.S. users are also subject to applicable state laws.

  • In the EU, any disputes shall be resolved through arbitration in Budapest, Hungary, under the rules of the Hungarian Chamber of Commerce and Industry, unless otherwise required by law. In the USA, dispute resolution will follow the state laws applicable to American National Dishes LLC’s registered office.

 

14. Changes to T&Cs

We may update these T&Cs at any time. Changes will be posted on www.wogi.pro/terms, and continued use of the Services constitutes acceptance.
